Cary J. Mogerman Sworn in to Executive Committee of the American Academy of Matrimonial LawyersOur colleague Cary J. Mogerman was sworn in as a member of the Executive Committee of the American Academy of Matrimonial Lawyers, assuming the office of Treasurer, on November 2, 2011. He was installed during the Academy’s annual meeting in Chicago, Illinois. He succeeds G. Thomas Vick, Esq., of Weatherford, Texas, who served the Academy as its Treasurer for seven years.

Super Lawyers Publication Recognizes Zerman Mogerman AttorneysAllan H. Zerman and Cary J. Mogerman have been recognized by the publication Missouri/Kansas Super Lawyers in the field of family law for the seventh consecutive year, commencing with 2005, the first year of its publication. Only 5% of the lawyers in the state are named to this list. Additionally, for the second year in a row, Stephanie L. Jones, Joseph J. Kodner and Patricia K. Susi have been designated a "Rising Star" by the publication. With their designation as a Super Lawyer "Rising Star," these attorneys have been recognized by their peers as being among Missouri’s top “up and coming” attorneys. According to the publication, Missouri lawyers are instructed to nominate lawyers they have personally observed in action – whether as opposing counsel or co-counsel, or through other firsthand courtroom observation; the nominated attorneys must be age 40 or under, or practicing for 10 years or less. The nominated lawyers are ranked by point totals and those with the highest point totals are named to the "Rising Stars" list. Only 2.5 percent of the lawyers in the state can be named to the list.

Best Lawyers Recognizes Zerman, Mogerman Once Again in Its 2011-2012 EditionAllan H. Zerman and Cary J. Mogerman have been selected once again for inclusion in the reference book, Best Lawyers, in its 2011-2012 edition. According to the publication, selection to Best Lawyers is based on an exhaustive and rigorous peer-review survey (comprising more than 3.9 million confidential evaluations by fellow attorneys) and because no fee or purchase is required to be listed, inclusion in Best Lawyers is rightly considered a singular honor. The annual, advertisement-free publication has been described by The American Lawyer as “the most respected referral list of attorneys in practice.” Zerman and Mogerman have been listed in the publication for more than 10 years each. In 2011, Allan Zerman was named “St. Louis Lawyer of the Year – Family Law” by Best Lawyers; In 2009, Cary Mogerman received the same honor from the publication.

Allan Zerman featured in HBO Documentary FilmAllan H. Zerman of our firm is among those featured and interviewed in the HBO documentary film "The Curious Case of Curt Flood" which is in current release on all HBO channels. The documentary examines Flood's historic legal challenge to major league baseball’s "reserve clause" in the 1972 case of Flood v. Kuhn, 407 US 258 (1972). The Flood suit was originally conceived by Zerman, who at the time was the personal attorney for the famous St. Louis Cardinal all-star outfielder. Flood's lawsuit is widely regarded as ultimately resulting in baseball free agency. The documentary traces Flood's early life and all-star career, which changed when he decided to resist a trade to the Philadelphia Phillies and consulted his lawyer Allan Zerman to discuss his options. Among others featured in the documentary are Marvin Miller, the former head of the Major League Baseball Players Association, St. Louis Cardinal Hall of Famers Bob Gibson, Tim McCarver, and Dal Maxville, and Flood's widow Judith Pace.
Patricia K. Susi of the firm has been elected by her peers to a three-year term on the Missouri Bar’s Family Law Section Executive Council. The Family Law Section of the Missouri Bar is one of the Missouri Bar’s largest and most active sections, and works to improve the legal system on behalf of families. The Section studies and considers all substantive laws of state and federal jurisdictions concerning the family, juveniles, divorce, maintenance, adoption, and other related laws. Its recommendations for changes in the common or statutory law are submitted to The Board of Governors of The Missouri Bar for their approval. The Executive Council leads and sets the agenda for the Family Law Section, and is composed of ten family law attorneys from throughout the State of Missouri.
Patricia is a 1999 graduate of the University of Missouri-Columbia School of Law and joined the firm of Zerman Mogerman LLC in 2007. She is a past-chair of the Family Law Section of the Bar Association of Metropolitan St. Louis (BAMSL) (2003), and a past-President of the Women Lawyers’ Association of Greater St. Louis (2008 – 2009). Patricia served as Vice-Chair on the Young Lawyers Division of BAMSL (2007-2008) and received the Award of Merit by YLD in 2004 and was named a Missouri Rising Star in 2009 and 2010 by Super Lawyers Magazine.

Joseph Kodner and Stephanie Jones Attend Academy of Matrimonial Lawyers Symposium on Business ValuationJoseph Kodner and Stephanie Jones of the firm attended the American Academy of Matrimonial Lawyers’ Institute for Advanced Family Law Associates in Chicago, Illinois June 25 – 28. The symposium included a day-long advanced program on business valuation issues in divorce cases which was presented by Jay E. Fishman, FASA and Stacy Preston Collins, CPA/ABV of Financial Research Associates, Inc. of Bala Cynwyd, Pennsylvania.
Joseph Kodner presented a continuing legal education program entitled “Yours, Mine, Ours & Theirs: Remarriage, Blended Families, and the Impact of the Reconfigured Family on Estate and Trust Issues” at the Missouri Bar’s 15th Annual Solo and Small Firm Conference on June 11, 2010. Mr. Kodner’s presentation encompassed a wide range of issues, including the impact that trusts have on the division of property in divorce, the proper classification of trust income for maintenance and child support purposes and the impact of the Missouri Uniform Trust Code on the collection of past due support payments. This year’s Solo and Small Firm conference had a record attendance of 1050 Missouri attorneys.

Penny Robinson LecturesPenny Robinson was a faculty participant at the NBI seminar Accounting 101 for Attorneys on September 17, 2009. The all-day seminar provided a comprehensive overview of financial records and accounting methods. Ms. Robinson addressed the use of accounting and financial records as evidence, obtaining vital documents, identifying potential experts and preparing an accountant serving as an expert witness for trial.

Allan Zerman Featured in Missouri Lawyers Weekly for His Role in the Historic Case of Flood vs. the CommissionerThe week that Major League Baseball’s 2009 All-Star Game was played in St. Louis, our partner Allan H. Zerman was profiled in the cover story of Missouri Lawyers Weekly for his role as attorney for St. Louis Cardinal outfielder Curt Flood in the landmark case largely credited as being the catalyst for free agency in professional sports. The case, Flood v. the Commissioner of Baseball, was decided by the United States Supreme Court in 1972. From the article:
Attorney Allan Zerman remembers the day Flood walked into his Clayton office. Zerman, then a young solo practitioner, had helped Flood before with a few simple incorporations. This time the issue was bigger.Allan Zerman was also one of two featured speakers at a symposium on the Flood case held during the annual meeting of the American College of Family Trial Lawyers in Savannah, Georgia, in April 2009. The other speaker, Brad Snyder, is the author of a recent book on the Flood case, “A Well-Paid Slave – Curt Flood’s Fight for Free Agency in Professional Sports.”
“He had just been told he was traded,” recalled Zerman, now 72 and practicing with the St. Louis firm of Zerman Mogerman. “We talked about his alternatives and options.”
One thing was clear. If Flood sued, he would have an uphill fight.
Baseball’s exemption from the Sherman Antitrust Act of 1890 had been affirmed by the Supreme Court in 1922 in Federal Baseball Club of Baltimore v. National League of Baseball Clubs and reaffirmed in 1953’s Toolson v. New York Yankees.
In a letter to Commissioner Bowie Kuhn, Flood made it clear that he saw the issue as one of economic civil rights:
“After 12 years in the major leagues, I do not feel that I am a piece of property to be bought and sold irrespective of my wishes. I believe that any system which produces that result violates my basic rights as a citizen and is inconsistent with the laws of the United States and of the several states.”
Kuhn rejected Flood’s plea, and the legal battle was on.

Academy Journal Publishes Article by Mogerman and JonesCary J. Mogerman and Stephanie L. Jones have co-authored an article entitled “The New Era of Electronic Eavesdropping and Divorce: An Analysis of the Federal Law Relating to Eavesdropping and Privacy in the Internet Age,” published in the most recent issue of the Journal of the American Academy of Matrimonial Lawyers. The article addresses the application of the federal wiretap and stored communications acts to current technologies sometimes seen applied in the context of domestic relations cases.

Zerman Featured in Super Lawyers Magazine ProfileAllan H. Zerman of the firm was prominently featured in an article published this fall by Missouri/Kansas Super Lawyers, a publication of Law and Politics Magazine. The article focuses upon Zerman’s role as the personal attorney for St. Louis Cardinals outfielder Curt Flood during the time of his famous legal challenge to major league baseball’s standard contractual "reserve clause," a challenge which went all the way to the U.S. Supreme Court and is reported as Flood v. Kuhn, 407 US 258 (1972). According to the article, in 1972 Zerman was just 35 years of age: "I don't know if I fully appreciated the magnitude of [the case] at the time," said Zerman in the article, the entirety of which may be viewed here.

Mogerman Recognized by Missouri Bar
Cary J. Mogerman of the firm has been presented with the 2008 Roger P. Krumm Family Law Practitioner Award by the Missouri Bar and its Family Law Section. The award "…recognizes one lawyer for exceptional competence, skill, integrity, commitment, and dedication toward the improvement and advancement of the practice of family law." The award was presented September 19 in Kansas City at the annual meeting of the Missouri Bar.

Mogerman among attorneys recognized in Worth magazineCary J. Mogerman of the firm was listed in Worth magazine’s December 2007 issue as one of the nation’s “top attorneys” serving the needs of affluent clients and their families. According to the magazine, Worth’s editors compiled a list of nominees who were asked to complete a detailed questionnaire and offer insight on important legal trends and specific counsel given to actual clients. The magazine’s editorial staff performed background checks on the nominees and considered client feedback.

Ms. Susi joins us with over seven years’ experience in litigation practice, with emphasis in family law. Ms. Susi is a 1999 graduate of the University of Missouri School of Law. During law school, Ms. Susi was the President of the Student Women’s Lawyers Association, and authored an article entitled “The Forgotten Victims of Domestic Violence,” which was published in the Journal of the Missouri Bar. Cary J. Mogerman was recently appointed to serve on two committees of the American Academy of Matrimonial Lawyers by the Academy’s incoming president, Mr. Gaetano Ferro of Connecticut. Mogerman will serve on the Academy’s Admissions Procedures Committee and its Institute for Family Law Associates Committee for the 2006-07 Academy year. Mr. Mogerman represents Missouri as its delegate to the Board of Governors of the American Academy of Matrimonial Lawyers and is a past-president of its Missouri Chapter. The American Academy of Matrimonial Lawyers was founded in 1962 “…to encourage the study, improve the practice, elevate the standards and advance the cause of matrimonial law, to the end that the welfare of the family and society be protected.” There are currently almost 1600 Fellows in 50 states, thirty five of whom practice in the State of Missouri.

While attending law school she served as President of the St. Louis University Public Interest Law Group, and participated in the moot court program as both an advocate and a teaching assistant. She is presently co-authoring an article on technology and privacy issues in the family law context for the Journal of the American Academy of Matrimonial Lawyers.

His law review note,“Re-introducing Lay Participation to Japanese Criminal Cases: An Awkward Yet Necessary Step” was published in the Winter 2003 issue of the Global Studies Law Review and honored as its Most Outstanding Note for 2003. Allan Zerman Inducted by American College of Family Trial LawyersAllan H. Zerman has been elected to membership in the American College of Family Trial Lawyers. The ACFTL is a select group of 100 of the top family law trial lawyers from across the United States. The American College was formed in 1993 to bring together some of the best trial lawyers in America practicing sophisticated and complex family law matters both domestically and abroad. Diplomates of the College are all members of the American Academy of Matrimonial Lawyers, and chosen based upon their recognized litigation skills and courtroom abilities. Mr. Zerman is a past-president of the Missouri Chapter, American Academy of Matrimonial Lawyers.
Cary J. Mogerman of the firm of Zerman Mogerman LLC has been appointed to a three-year term as Missouri’s delegate to the Board of Governors of the American Academy of Matrimonial Lawyers. Mr. Mogerman is a past-president of the Missouri Chapter of the Academy, and will represent the Missouri Chapter in all matters relating to the management of the national organization.

Penny Robinson to Chair St. Louis Bar’s Family Law SectionAttorney Penny Robinson of the firm of Zerman Mogerman LLC has been named Chair of the Family Law Section of the Bar Association of Metropolitan St. Louis. Her appointment is for one year, and entitles her to serve as a member of the Board of Governors of the Bar Association of Metropolitan St. Louis. Ms. Robinson held a similar distinction during her practice in Indianapolis, Indiana where she chaired the Family Law Section of the Indianapolis Metropolitan Bar Association.
